Trafficking in human beings: magistrates' perceptions

Trafficking in Human Beings has been gaining prominence in the political agendas of the various
governments, both nationally and internationally. The fight against this crime goes through the
entire justice system, since it’s the job of the police, prosecutors and magistrates to investigate
these crimes and the traffickers, bring them to trial and convict them accordingly. The objective
of this study was to access the perceptions of magistrates about the phenomena in general, the
legislation and the Portuguese situation on that domain, the victims and the traffickers. To this
end, a questionnaire on Trafficking in Human Beings was disseminated online. There were 167
magistrates practicing in Portugal who participated in this study. The results showed that, on
average, the magistrates revealed adequate perceptions about this phenomenon. In addition, it
was possible to conclude that the magistrates who presented more adequate perceptions were
those who consolidated their professional practice with the information obtained through the
formal and informal contacts with trafficking in human beings. However, there are gaps that can
be overcome with the target population, being, for this, it’s necessary the development of
sensitization and training actions adjusted to the same.
O Tráfico de Pessoas tem vindo a adquirir relevo nas agendas políticas dos diversos governos,
quer a nível nacional, quer a nível internacional. A luta contra este crime atravessa todo o sistema
de justiça, uma vez que é função da polícia, dos procuradores e dos magistrados investigar estes
crimes e os traficantes, levá-los a julgamento e condená-los em conformidade. O objetivo deste
estudo foi aceder às perceções dos magistrados acerca deste fenómeno em geral, acerca da
legislação e da situação portuguesa nesse domínio, acerca das vítimas e dos traficantes. Para tal,
foi disseminado online um questionário sobre o Tráfico de Pessoas. Foram 167 os magistrados a
exercer em Portugal que participaram neste estudo. Os resultados demonstraram que, em média,
os magistrados apresentavam perceções adequadas acerca deste fenómeno. Além disso, foi
possível concluir que os magistrados que expunham perceções mais adequadas eram os que
consolidavam a sua prática profissional com as informações conseguidas através dos contactos
formais e informais com o tráfico de pessoas. Contudo, há lacunas passíveis de serem superadas
junto desta população-alvo, sendo, para isso, necessário o desenvolvimento de ações
sensibilização e de formação ajustadas à mesma.
